Report submitted by the State is taken on record. It appears from the birth certificate of the petitioner as produced by him that the information with regard to the record of birth was taken from the register of Kakdwip Sub Divisional Hospital and records the date of birth as 20th March, 1982. But the report indicates that the Kakdwip Hospital was officially upgraded to Sub Divisional Hospital from Kakdwip Rural Hospital only in February, 2006. The birth certificate does not appear to be genuine. Charge sheet has been submitted. Allegation against the petitioner is under Section 14A (b) of the Foreigners Act and Section 12 of the Passport Act. Possibility of the petitioner fleeing from justice if released on bail at this stage cannot be ruled out. Considering the material on record, the prayer for bail is rejected at this stage.

The application for bail is disposed of.
