Roy, Ms. Tanusri Chanda ...for the State Mr. Srijan Nayak, Ms. Rituparna Maitra, Mr. Ankit Sureka, Mr. Biplob Das ...for the respondent no. 5 The grievance of the petitioners is apparently mitigated in view of the submission made by learned counsel appearing for the State.

Learned Counsel appearing for the State submits that, out of the two special officers, who were initially appointed, the petitioners had grievance against one. Subsequently, the said special officer has been withdrawn and only the remaining special officer is now officiating regarding the affairs of the society and the elections which are to be held.

Learned counsel appearing for the petitioners submits that the special officer be directed to expedite the election process.

In view of the above submissions, it is clear that the cause of action of the writ petition has become infructuous.

As such, W.P.A. No. 5188 of 2022 is disposed of by directing the special officer, who is functioning solely at present, to ensure that election process of the concerned co-operative society, that is, Dhubulia Samabay Krishi Unnayan Samity Limited, be conducted expeditiously.

The members of the said society, including the petitioners, shall extend all possible cooperation in that regard to the special officer.

There will be no order as to costs.

Urgent photostat certified copies of this order, if applied for, be made available to the parties upon compliance of all necessary formalities.
