Affidavit of service filed by the petitioner is taken on record.

None appears for the respondents despite service. Alleging unauthorised construction being raised by the private respondent, the petitioner submitted a complaint before the Pradhan, Shyambazar Gram Panchayat, being the 4th respondent herein, on 14th August, 2024. Upon receipt of such complaint, the 4th respondent issued notice upon the private respondent directing her to stop the work in the plot in question. Learned counsel for the petitioner submits that despite such stop work notice issued by the 4th respondent herein, the private respondent has completed the construction. The petitioner seeks necessary steps against the private respondent.

Upon consideration of the submission made on behalf of the petitioner, this Court directs the 4th respondent to conduct an enquiry with regard to the allegation made by the petitioner and on being satisfied with regard to the construction raised by the private respondent in violation of the stop work notice, to take necessary steps against the private respondent, in

accordance with law. The entire exercise shall be completed within eight weeks from the date of communication of the order.

The writ petition is accordingly disposed of. There shall however, be no order as to costs. Since no affidavit is invited, the allegations contained in the petition are deemed not to have been admitted. Urgent certified website copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities.
