Criminal Revisional Jurisdiction Appellate Side 28.3.2024 Item No.32 BR CRR 640 of 2018 In the matter of : Nripendra Nath Mondal Nobody appears on behalf of either of the parties. Even on earlier occasion nobody represented for the petitioner. No accommodation sought for.

This case is pertains to year 2018, as such this case is taken up for disposal on merit. Several opportunites were given to the petitioner but no one appeared on behalf of either of the parties.

This is an application filed by the petitioner under Section 482 of the Code of Criminal Procedure, 1973 challenging the order dated 6th January, 2018 passed by learned Additional Chief Judicial Magistrate , Rampurhat, Birbhum in Misc. Case No. 226 of 2017 thereby the learned Magistrate has allowed an application for enhancement the maintenance amount to the tune of Rs.

18,000/- for opposite party/wife from Rs.

17,000/- which was allowed earlier vide order dated 30th May, 2013. Rs. 12000/- for herself and Rs. 5,000/- per month for

her minor child totalling Rs. 17,000/-.

Now it has enhanced to Rs. 18,000/- for herself and Rs. 10,000/-for female child and the same order was effected from the date of 5th January, 2018 and directed the petitioner /husband to pay a total sum of Rs. 28,000/- as a current maintenance considering the intervening period, the price index of essential commodities has undergone a stiff inflation and also the salary of the petitioner /husband was increased to Rs.91748/- from Rs. 60,372/-. Amount of maintenance has been enhanced under Section 127 of the Cr. P.C. considering the income as well as the present status of the salary and value of the essential commodities.

Under such circumstances, this Court do not find any reasonable or sufficient grounds to interfere with the said impugned order.

Accordingly, CRR 640 of 2018 is, thus dismissed without any order as to costs.

Let a copy of this order be sent to the learned court below for information.

Urgent xerox certified copy of this order, if, applied for be given to the learned advocate for the parties on usual undertakings.
