Raju Roy v. State Of West Bengal & ORS.
Ct. No. 01 WPA 4351 of 2020 Raju Roy & ors.
Vs.
The State of West Bengal & ors.
AN S.S.
18.04.2023 Mr. Anil Kumar Chattopadhyay ... For the petitioners Mr. Amal Kr. Sen ... For the State
1. In this writ petition styled as a Public Interest Petition, the petitioners claim that though they have an autorickshaw permit, certain persons preventing them to ply the said auto-rickshaw. In this regard, complaint was lodged with the Superintendent of Police, South 24 Parganas on 12.04.2019 and alleging that no action was taken, the instant writ petition has been filed.
2. We find that there is no Public Interest involved in this matter and it appears to be purely a personal issue which is raised by few of the said auto-rickshaw permit holders. In any event, complaint was of the year 2019 and the writ petition was filed in the 2020 and as of now, no useful purpose would be served in keeping the writ petition pending since even when the matter was heard on 27.11.2020, prayer was made to adjourn the matter.
3. Hence, the instant writ petition is disposed of leaving it open to the writ petitioners to approach the appropriate authority, if need arises to do so.
