Mr. Gopal Ch. Ghosh Mr. Rajkrishna Mondal ... for the applicant/petitioner Mr. Basudev Gayen ... for the Municipality Sri Pintu Mahato, the alleged contemnor is present in Court as per direction of this Court passed on 22nd August, 2022. His personal appearance is dispensed with. Counsel on behalf of the alleged contemnor has filed a report dated 2nd September, 2022 which indicates that the boundary wall is above the maximum height and is accordingly, required to be demolished keeping the maximum height of about 6'6" out of which 5' to be solid in nature and rest ventilated as per Section 143 of the West Bengal Municipal (Building) Rule, 2007.

The alleged contemnor is directed to act as per report dated 2nd September, 2022 in accordance with law within a period of four weeks from date. In the event, the police assistance is required, the Officer-in-Charge of the concerned Police Station is directed to provide necessary assistance to the Municipality for carrying out the above work.

With the above observations, the contempt petition is disposed of. The contempt proceeding is dropped and the rule is discharged.
