Mr. Vidhya Bhusan Upadhyay .....For the Appellant/Petitioner The departmental note dated 10.08.2022 refers to order dated 31.03.2022 and an observation has been made that the direction is not clear. The order dated 31.03.2022 specifically under the heading of Re.:C.R.M.S.P.L. 17 of 2022 reflects 'The leave is granted'. Accordingly, it is for the petitioner to prefer an appeal within the statutory period. As the leave has been granted until and unless the Memorandum of Appeal is filed, the present matter would not proceed. Department is directed to send the records to Court only when a Memorandum of Appeal is preferred by the appellant/petitioner or until a further order is passed by a Court.
