Upon going through the pleadings and the nature of complaint filed by the petitioner before the police authorities, it is clear to the Court that the dispute between the parties is over the temple which exists on certain lands situated at village Sreebora under Daspur Police Station. It is alleged that the respondent nos. 6 to 13 and their men and agents, broke in to the temple and committed theft of valuable property belonging to deity.

It appears from the record that Daspur Police Station Case No.44 of 2022 dated February 7, 2022 had been registered. The investigation is going on. It also appears that on the complaint filed by the wife of the respondent no.8, Daspur Police Station Case No. 65 of 2022 has also been registered.

It is submitted that the investigation with regard to Daspur Police Station Case No. 65 of 2022 has been concluded.

This writ petition is disposed of with a direction upon the Officer-in-Charge, Daspur Police Station to conclude the investigation of Daspur Police Station Case No. 44 of 2022, in accordance with law and in a free, fair and impartial manner.

In the meantime, the police authorities shall also continue to keep vigil, so that no untoward incident takes place.

This writ petition is disposed of.

There will be, however, no order as to costs. All the parties are directed to act on the basis of the server copy of this order.
