This is an application seeking an expeditious disposal of a proceeding in which a charge sheet was submitted under Sections 323 and 498A read with Section 34 of the Penal Code and Sections 3 and 4 of the Dowry Prohibition Act.

Let a copy of this application be served upon Ms. Sujata Das, learned Counsel who ordinarily appear on behalf of the State. Let her represent the State. Her engagement may be regularised by the competent authority of the State in due course. Learned Counsel appearing on behalf of the petitioners submits as follows. The petitioners are the accused in this case. They are the mother in law and the husband of the de facto complainant/opposite party no.2. Although, the FIR was lodged on 08.05.2016 and a charge sheet was submitted on 28.06. 2016, till date the proceeding could not be concluded. Charges were framed on 11.12.2018. In fact, evidence of one witness out of a total of eight was recorded in 2019 itself. However, thereafter there were no progress in the trial. The matter has remained pending for no fault on the part of the present petitioner.

Learned Counsel appearing on behalf of the State submits that the State would not come in the way if a direction is passed to expedite the proceeding.

I have heard the submissions of the learned counsels appearing on behalf of the petitioner and the State and have perused the revision petition.

It appears that for an FIR which was registered in May, 2016, investigation was quite expeditiously done and a charge sheet was submitted in 2018 itself. It was only after 2019 that the delay occurred in conducting the proceeding.

In view of the above and in the interest of justice, the learned Court is requested to conclude the trial as expeditiously as possible without granting any unnecessary adjournment to any of the parties.

With the above observations, the revisional application is disposed of.
