The petitioner participated in a recruitment process for the post of Forest Guard under Directorate of Forests, Government of West Bengal in 2017. The petitioner is challenging the recruitment process, inter alia, by directing the respondents and/or their men, agents or subordinates to provide full disclosure of the written test in respect of the said recruitment process. The other prayers are also in consonance with the main relief sought for in the writ petition. Admittedly, the recruitment process is in respect of a civil post under the State.

In view of the provisions of Section 15(a) of the Administrative Tribunals Act, 1985 (hereinafter referred to as the said Act), the appropriate forum is the West Bengal Administrative Tribunal constituted under the said Act.

In the aforesaid facts and circumstances, the writ petition is disposed of by granting liberty to the petitioner to approach the appropriate forum, if permissible in law, on the self-same ground.

The time consumed between 28th February, 2024 and till date (03.07.2024) shall be construed to have been proceeded by the petitioner in a bona fide manner before a forum without jurisdiction.
