Petitioners are in custody since August, 2021 and records reflect that the charge was framed on September, 2022. The report so submitted on behalf of the State reflects that on number of dates summons were issued to the witnesses but the said summons are not traceable by the police authorities as is reflected from the report submitted by the Superintendent of Police, Jangipur Police District.

This court earlier passed a direction upon the all the SPs and the Commissioner of Police of the concerned District and the areas concerned for maintaining register for monitoring the progress of the cases relating to the Special Act. The present petitioners are in custody for more than two years eight months and none of the witnesses have been examined till date. The special court being the learned ADJ, 5th court, Berhampore, Murshidabad is directed to communicate with the

Superintendent of Police of Jangipur Police District by issuing summons in respect of the witnesses who are required for the purposes of the present case to depose. The Office of the Superintendent of Police, Jangipur Police District will ensure regarding the availability of the witnesses on the dates so fixed A schedule be fixed consisting of three dates and such schedule would be fixed once in every twenty days so that the trial of the case can be taken to its logical conclusion within a reasonable period of time.

No unnecessary adjournments should be granted to either of the parties.

The Public Prosecutor appearing in the case would produce the materials, documents and exhibits on the dates fixed for examination of the witnesses concerned.

It is directed that the trial of the case would continue in spite of the resolution of the local bar and the learned participating/representing advocate will not stall the proceedings because of any such resolution.

All efforts be taken by the stake-holders to conclude the trial at the earliest.

With the aforesaid observations, the present revisional application being CRR 888 of 2024 is disposed of. Pending applications, if any, are consequently disposed of. Report so submitted by the S.P of Police, JPD be kept with the record.
