Kausik (Allowed) CRM (NDPS) 454 of 2026 In Re: An Application for Bail under Section 483 of the Bharatiya Nagarik Suraksha Sanhita, 2023/ Section 439 of the Code of Criminal Procedure, 1973 in connection with Lalgarh Police Station Case No. 60 of 2025 dated 25.05.2025 under Section 21(C) of the NDPS Act, 1985.

Learned advocate appearing for the petitioner submits that petitioner is in custody for 10 months, charge sheet has been submitted, charges have been framed and the prosecution intends to examine 11 witnesses in support of its case and the quantum of recovery in the present case is 1 Kg. 444 Gms. of Codeine Mixture.
Learned advocate for the State submits that so far as the prosecution is concerned, CFL report has been submitted along with the supplementary charge sheet and the report confirms the contraband to be Codeine Phosphate.
Having considered the quantum of recovery, period of detention of the present petitioner and the possibility of time which will be consumed for completing the trial, I am inclined to release the petitioner on bail without entering into the merits of the case.
Accordingly, the prayer for bail of the petitioner is allowed.
Accordingly, Petitioner, namely, Sk. Nuru @ Sk. Naru shall furnish bond of Rs. 20,000/- (Rupees Twenty Thousand Only) with two sureties of Rs. 10,000/- (Rupees Ten Thousand Only) each. One of whom must be local to the satisfaction of Learned Additional Sessions Judge, 1st Court, Jhargram & Special Court under NDPS Act, Jhargram.
If on bail petitioner shall be physically present on each and every date fixed by the learned Trial Court and shall not leave the jurisdiction of District of Jhargram without the prior permission of the learned Special Court.
Accordingly, CRM (NDPS) 454 of 2026 is allowed. Report submitted by the State be kept with the record. All parties shall act in terms of server copy of the order downloaded from the official website of this Court. Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities.
