It is not in dispute that the land of the petitioners was requisitioned by the State Authorities for extension of public road and L.A. case No. 47/78-79, which was initiated for the purpose, stood lapsed. Admittedly the land has been handed over to the requiring body in 1980, but no compensation has been paid to the petitioners for the same.

It is submitted on behalf of the State respondents that the respondents are agreeable to purchase the land in question from the petitioners directly at the present market value. Learned counsel for the petitioners agrees to the said proposal of the State respondents.

Accordingly, the writ petition is disposed by directing the 6th respondent to initiate the proposal for direct purchase of the land in question from the petitioners at the present market value of the land

and complete the entire exercise within three months from the date of communication of this order after giving reasonable opportunity of hearing to all the interested parties, in accordance with law. W.P.A. 6274 of 2021 is thus disposed of.

There shall be no order as to costs.

Since no affidavit has been invited, allegations contained in the writ petition shall be deemed not to have been admitted. Urgent certified website copy of the order, if applied for, be given to the parties on compliance of requisite formalities. (Suvra Ghosh, J.)
