Petitioners submit that the complainant was never in the matrimonial home and her evidence in the proceedings under Section 12 of the PWDV Act and in the letter of complaint addressed to Baguihati P. S. Case No. 51 of 2024 dated 22-01-2024 are contradictory.

Since the subject matter of the case was preceded by a proceedings under the provisions of PWDV Act, I am of the view that the petitioners would be at liberty to take up the issues which are in their possession in respect of the other proceedings in Misc. Case No. 311 of 2022 before the Investigating Officer as also the superior police officer to ventilate their grievance in respect of the delayed criminal case being filed as also the intention with which the present complaint has been filed for registration of the FIR. The concerned officer would take into account and deal with the same before a report under Section 173 of the Code of Criminal Procedure is filed before the jurisdictional court.

With the above observations, the present revisional application being CRR 900 of 2024 is disposed of. Pending applications, if any, are consequently disposed of. All concerned parties are to act in terms of a copy of this order duly downloaded from the official website of this court. [Tirthankar Ghosh, J]
