In CAN 1 of 2022 it was alleged that in Bogtui incident, villagers out of fear had left their houses. Hence, the names of the person requiring confidence and assistance of the administration to return back to their homes were disclosed in paragraph 7 of the application and a direction was sought to the police authorities to ensure that the persons so named easily enter their village.

The report in the form of affidavit filed by the State today discloses that out of 15 such persons, 12 were staying in their village i.e., village Bogtui and 3 persons are staying at village Kumadda which is an adjacent village as their houses are in damage condition. The names of the person who are staying in their houses after

repairing has also been disclosed in the report. It is mentioned that for their safety and security purpose and to prevent of any untoward incident police picket duty is running round the clock at Bogtui village and also patrolling duty has been introduced continuously. The report mentions that it has been conveyed to such persons that if they want to stay in their own houses the police is always ready to render police assistance for their safety and security purpose.

Hence, the grievance which was raised in CAN 1 of 2022 has been redressed. Accordingly, CAN 1 of 2022 is disposed of.

By earlier order dated 11th July, 2022 other writ petitions involving the issue raised in the present petition have already been disposed of and on account of pendency of CAN 1 of 2022 present petition was kept alive.

Hence, in view of the detailed order passed on 11th July, 2022 the present petition is also disposed of. (Prakash Shrivastava, C.J.) (Rajarshi Bharadwaj, J.)
