Purnima Bhuyar And ANR v. State Of West Bengal
(AD) 28.03.2022 C.R.M. (A)1403 of 2022 Court No.29 (Rejected) In Re: - An application for anticipatory bail under Section 438 of the Code of Criminal Procedure in connection with Gangarampur P.S. Case No.135 of 2022 dated 11/03/2022 under Sections 363/365/34 of the Indian Penal Code read with Section 6 of the Protection of Children from Sexual Offences Act. And In the matter of: - Purnima Bhuyar & Anr.
...petitioners.
Ms. Busra Khatoon ... for the petitioners.
Mr. S.S. Imam Sk. Arif Hossain ...for the State.
Petitioners seek anticipatory bail.
Learned Advocate appearing for the petitioners submits that the principal accused is still in custody. The petitioners were falsely implicated.
Learned Advocate appearing for the State submits that the victim in her statement recorded under Section 164 of the Code of Criminal Procedure narrates that she was taken and kept at the residence of the petitioners where she was ravished. It appears from the statement recorded by the victim under Section 164 of the Code of Criminal Procedure that the victim is 13 years of age. She states that she was ravished at the residence of the petitioners by the principal accused. The petitioners, in fact, locked her in the house. Considering the gravity of the offence and the involvement of the petitioners therein as transpiring from the statement of the victim recorded under Section 164 of the Code of Criminal
Procedure, we are unable to enlarge the petitioners on anticipatory bail.
Accordingly, the prayer for anticipatory bail of the petitioners is rejected.
C.R.M. (A) 1403 of 2022 is dismissed.
