The petitioner is the complainant who is aggrieved by the manner in which there has been progress in connection with Shakespeare Sarani Police Station Case No. 206 of 2018 dated 02.08.2018. Records reflect that the accused persons are yet to receive copies for the court to progress to the stage of consideration of charges. I find that on repeated occasions, the learned Metropolitan Magistrate, 4th Court, Calcutta directed as last chance in default warrant of arrest. However, the same has not been done.
In case the opposite parties do not abide by the orders passed by the learned Metropolitan Magistrate, 4th Court, Calcutta, in that case the learned Magistrate would implement the issuance of harsher process of law directing the Shakespeare Sarani Police Station to take steps for ensuring the availability of the accused persons within a period of seven days from the next date so fixed. The court thereafter would hand over the copies and proceed to the stage of consideration of charges within 15 days thereafter. It would be the discretion of the said court to impose condition of bail, in case they are brought by the police authorities.
After consideration of charges, if the learned trial court is of the opinion that the trial of the case should proceed, the learned trial court would fix at least one date in a month so that trial of the case can be taken to its logical conclusion within a reasonable period of time.
With the aforesaid observations, the revisional application being CRR 898 of 2024 is disposed of. Pending connected application, if any, is consequently disposed of.
