AND In the matter of:- Bijay Dutta Ray ... petitioner The revisional application has been preferred against the order dated 24.11.2011, passed by the learned Judicial Magistrate, 4th Court, Hooghly, Sadar, wherein, the learned Magistrate was pleased to award interim maintenance of Rs.5,000/- per month to the wife and Rs.4000/- per month to the minor son, aggregating to Rs.9,000/-.
Having regard to the fact that the said award of maintenance was by way of interim measure during the pendency of the main proceeding under Section 125 of the Code of Criminal Procedure, I am of the view that no interference is called for. Accordingly, C.R.R.705 of 2012 is dismissed.
Pending application, if any, is hereby disposed of. Interim order, if any, is hereby vacated.
The opposite party/wife will be at liberty to recover the arrears by taking out an appropriate application before the learned Magistrate.
