State of West Bengal Mr. Farooque Ali Mr. Faizan Md. Zofar ...for the Petitioner In this application the petitioner has prayed for a direction upon the court below for expeditious disposal of the interim maintenance application filed by the petitioner on 13th February, 2025.

Being aggrieved by the inordinate delay caused in disposal of the interim maintenance prayer learned counsel for the petitioner submits that petitioner is under the threat of starvation and in spite of expiry of more than one year the said application is pending for disposal. Therefore, he prayed for necessary direction upon the court below for expeditious disposal of the said application. Having heard learned counsel for the petitioner, I find that the prayer made by the petitioner is innocuous and if it is allowed in terms of the prayer made therein, the opposite party will have no cause to prejudice and as such, the service of copy of application upon the opposite party is hereby dispensed with.

Having considered the long pendency of the interim maintenance application, I find that the prayer made by the

petitioner is justified and is required to be allowed for securing the ends of justice.

In view of the above, the instant application being CRR 1103 of 2026 is hereby disposed of with a direction upon the court below to dispose of the petitioner's application for interim maintenance dated 13.02.2025 on the next date of hearing i.e., on 24.08.2026 or preferably within a period of one month thereafter.

Urgent Photostat certified copy of this order, duly applied for, be given to the parties upon compliance of all requisite formalities.
