The petitioners complain of alleged inaction and over action on the part of the Contai Police Station. The petitioners claim inaction since a complaint against the private respondents in respect of land has not been taken cognizance of.

On the contrary, Contai Women Police Station has registered FIR No. 80 of 2022 dated 22.06.2022 against the petitioners, inter alia, under Section 354 of the IPC.

On the complaint of the wife of the petitioner and directions of the Jurisdictional Magistrate, Contai Police Station has also registered FIR No. 516 of 2022 dated 26.12.2022.

Contai Police Station has investigated both the aforesaid FIRs and filed charge sheets.

The petitioners in the meantime have filed T. S. No. 85 of 2022 before the learned Civil Judge (Junior

Division), 1st Court at Contai in which there is an injunction.

This Court is of the view that appropriate remedies have been availed by both the petitioners and the private respondents.

Contail Police Station shall, however, ensure that there is absolutely no breach of peace in the area and all orders of the Civil Court shall be complied with by them.

Report of the Contai Police Station is taken on record.

9.

The writ petition is disposed of.

10.

There will be no order as to costs.

All parties are directed to act on a server copy of this order duly downloaded from the official website of this Court.
