C.R.R.618 of 2021 D/L20 05.01.2023 Bpg.

In Re: An application under Section 482 of the Code of Criminal Procedure;

Mahabur Rahaman Gazi

Versus

The State of West Bengal Mr. Anshuman Chakraborty.

...for the petitioner.

Mr. Saswata Gopal Mukherjee, Ld.P.P., Mr. Arijit Ganguly, Mr. Sanjib Kr. Dan.

...for the State.

The revisional application has been preferred in connection with N 43/2020 arising out of Basirhat Police Station Case No.186 of 2020 dated 10.02.2020 under Section 21(C) of the NDPS Act pending before the learned Additional District and Sessions Judge, 6th Court, Barasat, North 24-Parganas. The petitioner has prayed for expeditious disposal of the case.

It has been informed that one of the witness has been examined. However, the case has not progressed in spite of more than four years having been passed.

I have considered the plight of the present petitioner who has been saddled with charges under Section 21(C) of the NDPS Act.

If the evidence of the case has not been completed till date, I direct the learned Magistrate to fix a schedule of three dates

and regularly in a month fix a schedule so that the trial of the case can be taken to its logical conclusion within a reasonable period of time.

No unnecessary adjournments should be granted to either of the parties.

The witness should not be excused from appearing in court on vague and flimsy grounds. All efforts must be taken to conclude the trial at the earliest.

With the aforesaid observations, CRR 618 of 2021 is disposed of.

All parties shall act on the server copy of this order duly downloaded from the official website of this Court. Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance of all requisite formalities.
