This is an application filed by the defendant No.1 seeking expeditious disposal of Title Suit No.265 of 2011 pending before the learned Civil Judge (Junior Division), 2nd Court at Alipore, District-24-Parganas (South). It is submitted by the learned Advocate for the petitioner that the suit has been dragging for a considerable time. Records reveal that on March 15, 2018, the issues were framed and 18th May, 2018 was fixed for peremptory hearing. Since then, the suit has not progressed. It is submitted that an interlocutory application as also an interlocutory proceedings are pending before the learned Court below.

Under such circumstances, in my opinion, considering the age of the suit, the learned Court below is directed to dispose of the Title Suit No.265 of 2011 along with all pending applications and proceedings as expeditiously as possible preferably within a period of one year from the date of communication of this order. Time limit herein is mandatory.

This Court has not gone into the merits of the claim and counterclaim of the parties and the learned Court below will dispose of the suit independently and in accordance with law. The learned Advocate-on-record for the petitioner is directed to serve copies of this revisional application upon the opposite parties along with a server copy of this order within a period of seven days from date.

This revisional application is, thus, disposed of. There will be, however, no order as to costs. Urgent photostat certified copy of this order, if applied for, be given to the parties on priority basis. (Shampa Sarkar, J.)
