Affidavit of service be kept with the record. This is an application for recording compromise and passing necessary order in the instant revision. Dholahat Police

Station Case No. 54 of 2020 was registered under Section 406 of the Indian Penal Code on 11th February, 2020. The dispute was regarding non-payment of sum of Rs.60,000/- with interest of Rs.4,000/- and Rs.200/- total being Rs.64,200/-. During pendency of the case ombudsman of R.B.I. intervened into the matter. As per direction of the ombudsman the petitioner paid the entire amount to the opposite party No.2. Offence under Section 406 of the Indian Penal Code is compoundable. The learned advocate for the opposite party No.2 has also admitted that he has received the entire amount of money and at present he has no grievance.

In view of such circumstances, the compromise petition be accepted. CRAN 1 of 2021 is disposed of with the order that the dispute between the parties on the basis of G.R. Case No.225 of 2020 arose has been compromised and in view of such compromise between the parties the proceeding in G. R. Case No.225 of 2020 be quashed.

The compromise petition be made part of this order. (Bibek Chaudhuri, J.)
