The petitioners in the instant application under Article 227 of the Constitution of India have prayed that a direction may be issue that the Title Suit No. 441 of 2017 pending before the Learned Judge 8th Bench, City Civil Court at Calcutta be disposed of expeditiously.

In the facts and circumstances, this Court is of the view that no fruitful purpose will be served by causing service of notice upon the opposite parties. Thus, this application being CO 915 of 2020 stands disposed of with a request upon the Learned Judge 8th Bench, City Civil Court at Calcutta to dispose of the Title Suit No. 441 of 2017 within a period of four months from the next date fixed without

granting any unnecessary adjournment.

It is hereby made clear that this Court has not gone into the merits of the case and all point will be kept open.

Urgent photostat certified copy of the order, if applied for, be given to the parties on usual undertakings.
