No. 26 CHC Allowed C.R.M.(A) 877 of 2025 In Re:- An application for anticipatory bail under Section 438 of the Code of Criminal Procedure, 1973/under Section 482 of the Bharatiya Nagarik Suraksha Sanhita, 2023, in connection with Kaliachak Police Station Case No. 28 of 2020 dated 08.01.2020 under Sections 147/ 148/ 149/ 186/ 332/ 333/ 353/307/379/427/436 of the Indian Penal Code, 1860, read with Sections 3/ 4 of Prevention of Damage to Public Property Act, 1984 read with Sections 3/ 4 of Explosive Substance Act, 1908 with Sections 9/15A of the West Bengal Maintenance of Public Order Act, 1972, Section 8(b) of National Highways Act, 1956.

And In the matter of : Alal Hoque @ Alal Sekh ...... petitioner Md. Wasim Akram, Advocate ....for the petitioner Mr. Pravash Bhattacharya, Advocate ....for the State

1. Claim for parity with other coaccused who were enlarged on anticipatory bail by the order dated March 5, 2025 is not being disputed on behalf of the State.

2. In such circumstances, we grant anticipatory bail to the petitioner.

3. Accordingly, we direct that in the event of arrest the petitioner shall be released on bail upon furnishing a bond of Rs.10,000/- (Rupees Ten Thousand only), with two sureties of like amount each, to the satisfaction of the arresting officer and also be subject to the conditions as laid down under Section 482(2) of the Bharatiya Nagarik

Suraksha Sanhita and on condition that they shall appear before the jurisdictional court and pray for regular bail within a period of four weeks from date.
