The petitioner's application for transfer has been rejected by the concerned District Inspector of schools (SE) keeping in mind the volume of students, the work of the school will be hampered. In a sense the concerned District Inspector of Schools (SE) indirectly applied the pupil teacher ratio.

The said ground is not acceptable within the scope of the 2015 Rules.

Hence, the order of the concerned District Inspector of schools (SE) shall stand set aside. The school shall forward the petitioner's application back to the concerned District Inspector of schools (SE) immediately. The concerned District Inspector of Schools shall process the petitioner's application for transfer in terms of the 2015 Rules within a period of six weeks from the date of communication of a copy of this order.

With the aforesaid observations, the writ petition is disposed of.

There shall be no order as to costs.

All parties shall act on the server copy of this order duly downloaded from the official website of this Court.
