1. The petitioners are elected members of a Zilla Parishad complaining against the Prodhan.

2. If the petitioners themselves are elected members of the Panchayat, are unable to control the activities of the Prodhan of the Panchayat, then the petitioners are unfit to represent the public in the Panchayat.

3. There are sufficient remedies available under the West Bengal Panchayat Act to take action against the Prodhan if the allegations are true which, however, have been denied by the learned advocate for the Prodhan.
