1. Report filed on behalf of State is kept on record.

2. Petitioner submits he has already refunded Rs. 91 lakh and is willing to deposit the outstanding sum of Rs. 9 lakh before the jurisdictional court subject to the result of the litigation.

3. In light of the aforesaid submission we modify the condition of bail in the following manner :

(i) Petitioner shall deposit the sum of Rs. 9 lakh with the jurisdictional court subject to the result of the litigation and upon such deposit being made the court shall keep the amount in an interest bearing auto renewing fixed deposit account maintained with a nationalized bank till disposal of the case.

(ii) Subject to the aforesaid deposit being made, the passport deposited by the petitioner to the investigating officer shall be returned to him. He shall be at liberty to renew his passport in accordance with law. In the event

he fails to deposit the said amount as aforesaid the passport shall not be returned.

(iii) Petitioner shall be permitted to go abroad subject to permission granted by the trial court.
