The petitioner is claiming to be the dependent widowed daughter of a deceased teacher of a secondary school.

The grievance of the petitioner is that her application for family pension is pending before the Director of Pension, Provident Fund and Group Insurance, Government of West Bengal, the respondent no.3 herein for a long time.

The petitioner, by the instant writ petition, is praying for a direction upon the said respondent for taking immediate step for disposal of the said application.

The application for family pension of the widow, divorced and unmarried daughter of a teacher is required to be rooted through the head of the institution of the concerned teacher but the application of the petitioner has travelled in a wrong root.

Mr. Das, learned advocate for the petitioner submits that to avoid unnecessary complications his client may be permitted to withdraw the present writ petition with a liberty to apply for such family pension through proper channel.

This is the correct approach. Therefore, W.P.A. 5271 of 2022 is dismissed as not pressed without any order as to costs.

This order, however, will not prevent the petitioner to apply for family pension in accordance with the procedure prescribed under the law.

Urgent photostat certified copy of this order, if applied for, be supplied to the parties subject to compliance with all requisite formalities.
