Let a copy of the revisional application be served upon Ms. Manisha Sharma, learned counsel, who ordinarily appears on behalf of the State. She is requested to appear in this matter. Her engagement may be regularised by the competent authority of the State in due course.

Learned counsel appearing on behalf of the petitioner submits as follows. The petitioner is the de facto complainant in this case. He had lodged an F.I.R. on 07.03.2018. After a perfunctory investigation the Investigating Agency filed a final report dated 26.01.2019. The petitioner filed the protest petition on 24.03.20214. However, till date the same could not be heard out and disposed of. The same has remained pending for no fault on the part of the petitioner.

Learned counsel appearing on behalf of the State submits that State would not come in the way if a direction is passed for an expeditious disposal of the proceeding.

I have heard the submissions of the learned counsels for the appearing for the petitioner and the State and have perused the revision petition.

No prejudice will be cause to anyone if a direction is passed to expedite the proceeding.

It appears that the protest petition has remained pending since 24.03.2021.

In view of the above and in the interest of justice, the learned Trial Court is requested to conclude the proceeding as expeditiously as possible and in particular, to dispose of the protest petition filed on behalf of the petitioner at the earliest, preferably within four months from the next date of hearing With these observations, the revisional application is disposed of. Urgent photostat certified copy of this order, if applied for, be given to the parties, upon completion of requisite formalities. (Jay Sengupta, J.)
