It is submitted by the learned Counsel for the appellant that when the matter was called on 17.01.2020, the counsel was on way to this Court when his car broke down. On account of breakdown of the car he was unable to reach the Court in time and also could not intimate his office to seek an adjournment on the said date.

The application has been filed on 14.02.2020, i.e., within a month of the dismissal in default.

We therefore find the explanation to constitute sufficient cause for restoration of the appeal.

The appeal is restored to its original file and number and is now to be listed for admission under the heading 'Order XLI Rule 11'.

The application being CAN 2 of 2020 (old No. CAN 1677 of 2020) stands disposed of.
