No. 05 WPA 5290 of 2022 Rahutara St. Thomas High School(H.S.) -versus- The State of West Bengal & Ors Mr. Prahlad Chnadra ghosh Mr. Subir Hazra Mr. Swapan Kumar Chatterjee ... for the petitioner Mr. Supriya Chattapadhyay Ms. Tapati Samanta ....... for the State The relief sought for by the petitioner, which is the Government aided Institution recognized by the West Bengal Board of Secondary Education, is for consideration of a representation made by the Headmaster of the School to the District Inspector of Schools on 12th April, 2018 together with a Report of the D.I.(S.E.), Malda for sanctioning of a post for one Librarian and one Clerk of the petitioner's School. Counsel submits that the students in the said School are mostly SCs and STs and there is an urgent need of sanction of the post of Librarian for the benefit of the students.

The State is represented.

After hearing learned counsel and considering the relevant documents, it appears

that the D.I.(SE), Malda had written to the Commissioner of Education, West Bengal on 4th May, 2018 enclosing inspection report and other relevant documents in connection with sanctioning of one post of Clerk and one post of Librarian. Let the documents be considered by the respondent No. 2 namely the Commissioner of School Education, West Bengal. The Commissioner of School Education shall hear all necessary parties including the Headmaster of the petitioner before disposing of the representation by way of a reasoned order. The representation shall be disposed of within a period of eight weeks from date and a copy of the reasoned order be made available to the petitioner within a week from the date of such reasoned order.

WPA 5290 of 2022 is disposed of in terms of the above.
