Mr. Abdul Hadi .....for the petitioners The present writ application has been preferred praying for direction upon the respondents Barrackpore Municipal Authority to demolish the dilapidated portion of the building on taking necessary steps for eviction of the illegal occupants.

It appears that in spite of service none of the respondents are being represented.

It further appears that a representations have been submitted by the petitioner on 20.12.2018 and 22.01.2019 to the Chairman of Barrackpore Municipality but till date no action has been taken on the said representations.

It is submitted that the condition of the said dilapidated building is endangering the lives of the occupants and their neighbours and as such necessary orders may be passed.

On considering the said submissions and the materials on record, the writ application is disposed of with the direction that the Chairman Barrackpore Municipality shall consider the representations of the petitioner dated 20th December, 2018 and 22nd

January, 2019 in accordance with law within 60 days from the date of this order, on hearing the petitioner and the other occupants of the alleged dilapidated building and on hearing the parties shall pass a reasoned order which shall be communicated to the parties.

In case the Municipality finds that the said building requires action on the part of the Municipality under its rules, the Municipality shall be at liberty to take all necessary steps in accordance with law to ensure that the building rules are complied with.

The writ application is accordingly disposed of.

Applications, if any, connected thereto stand disposed of consequently.

Interim order, if any, stands vacated.

Photostat certified copy of this order, if applied for, being given to the parties on priority basis upon compliance of all formalities.
