Learned advocate appearing on behalf of all the parties submits that the Civil Suit challenging the municipal election of Kandi Municipality, Ward No. 16 is pending consideration before the Learned District Judge, Murshidabad.

In view of the provisions of the West Bengal Municipal Elections Act, 1994, the present writ petition is not maintainable before this Court.

The writ petition stands dismissed.
