The State of West Bengal Mr. Sourav Mondal Mr. Arijit Bhuiya Mr. Rony Mondal Mr. Debarghyo Sil ...for the Petitioner This is an application wherein the petitioner has prayed for expeditious disposal of the T.R. case no. 43 of 2023, presently pending before the learned Magistrate, 1st Court, North 24 Parganas, Barasat.
It is submitted on behalf of the petitioner that the petitioner lodged a complaint on 21.3.2023 and thereafter, the learned court below had taken cognizance on the offence on 20th May, 2024 and the court below fixed the next date for appearance and service return on 19.11.2024. Since then, the case did not proceed further. The complainant is presently aged about 75 years and is suffering great hardship due to long pendency of the proceeding.
Having heard learned counsel for the petitioner, it appears that the prayer made by the petitioner is innocuous and if it is allowed in terms of the prayer made therein, the State/opposite party will have no cause to prejudice and as such, the service of copy of application upon the opposite party/State is hereby dispensed with.
Having gone through the certified copy of the ordersheet and considering the fact that the stereotype orders are being passed by the court below for a considerable period of time without taking any proper steps for early disposal of the case, I find that the prayer made by the petitioner is justified and is required to be allowed for the ends of justice. In such view of the matter, the instant application being CRR 1113 of 2026 is hereby disposed of with a direction upon the court below to make every endeavour for expeditious disposal of the complaint case being T.R. case no. 43 of 2023 in Complaint case no. 389 of 2023 and to make his best endeavour to conclude the entire proceeding preferably within a period of six months from the next date of hearing. Urgent Photostat certified copy of this order, duly applied for, be given to the parties upon compliance of all requisite formalities.
