30.11.2022 Court No.238 Item No.85 sp WPA 4572 of 2019 Roushan Mandal Vs.

The State of West Bengal & Ors.

Mr. Chittaranjan Ray ....for the petitioner The University is not represented.

Petitioner is an aspirant for the post of Assistant Professor in Environmental studies at Rabindra Bharati University under OBC-A category. He has a "Master of Arts" degree in "Environmental Studies."

The relevant advertisement indicates that the recruitment process was initiated for the post of Assistant Professor in "Environmental Studies."

The petitioner submits that a candidate with a "Master of Science" degree in "Environmental Science" has been selected for the said post. He was not eligible to be appointed to the post in question with the said qualification.

The petitioner, however, fails to demonstrate before this Court that why a person with a master degree in Environmental Science cannot participate in the selection process for the post of Assistant Professor in "Environmental Studies." In the advertisement it has not been mentioned that the essential qualification to

participate in the selection process was Master of Arts in "Environmental Studies" only.

I am of the view that both the qualifications namely, Master of Arts in Environmental Studies and Master of Science in Environmental Studies were valid qualifications to participate in the selection process. Therefore, it cannot be said that the candidate who was selected for the post in question was not eligible to participate in the selection process.

In that view of the matter, the challenge with regard to the selection fails.

Accordingly, WPA 4572 of 2019 is dismissed.
