The application under Section 5 of the Limitation Act is taken up for hearing.

It is found from the Office Report that special leave to file appeal is barred by limitation by 123 days.

I have heard the learned Advocates for the parties and perused the application under Section 5 of the Limitation Act. The petitioner has been able to establish sufficient cause for delay in filing the application for special leave to appeal and the cause shown being sufficient, delay is condoned.

The application under Section 5 of the Limitation Act is allowed.

CRMSPL 20 of 2020 is taken up for hearing.

I have heard the learned Advocate for the petitioner and perused the order dated 31st August, 2019. Special leave to file appeal is allowed.

The petitioner is at liberty to file memorandum of appeal within 30 days from the date of this order.
