Learned advocate for the petitioner submits that the petitioner is aggrieved by the manner in which the Sessions Case No. 9(03) of 2017 presently pending before the learned Additional Sessions Judge, Kalyani, Nadia is progressing.
Ms. Ray, learned advocate draws the attention of this court to the orders of the trial court and submits that for a considerable period of time, the witnesses are not available for being examined.
In view of the submissions so advanced by the learned advocate for the petitioner, she is directed to serve upon Mr. Md. Anwar Hossain, Advocate who ordinarily appears for the State.
Having regard to the fact that the charge was framed in the year 2017 and till date the trial of the case could not progress, I direct the learned trial court to take steps so that the Office of the concerned court can communicate with learned Public Prosecutor conducting the case who will assure the court regarding the availability of the witnesses and thereafter dates/schedule would be fixed for evidence.
The learned trial court is further directed that at least three dates in a schedule should be fixed, once in every two months so that the trial of the case can be progressed and taken to its logical conclusion within a reasonable period of time. No time schedule is fixed for the present. However, the learned trial court will exercise its authority so that there is no unnecessary delay or adjournment taken at the instance of either of the parties.
With the above observations, CRR 855 of 2020 is disposed of.
