This revisional application has been filed praying for expeditious disposal of Mat. Suit No.1095 of 2018 pending before the learned Additional District Judge, Fast Track CourtIII at Howrah. The petitioner submits that the suit is at the stage of evidence and the examination-in-chief of the PW has already started.

Having considered the contentions of the petitioner and the innocuous prayer made, this Court finds that justice would be sub-served, if the revisional application is disposed of by directing the learned Court below to dispose of the matrimonial suit within a period of six months from the next date fixed upon allowing the wife to contest the proceedings, in accordance with law.

This Court has not gone into the merits of the contentions of the petitioner or into the merits of suit. The

learned Court below shall proceed in accordance with law and independently.

This order will be operative only if the husband pays the maintenance pendente lite and the litigation costs, if payable as per orders by the learned Court below, regularly and without any default. In case of default, the learned Court below shall proceed in accordance with law.

The learned Advocate-on-record for the petitioner is directed to serve a copy of this revisional application upon the opposite party/wife along with a server copy of this order immediately.

The revisional application is disposed of.

There will be, however, no order as to costs. Urgent photostat certified copy of this order, if applied for, be given to the parties on priority basis. (Shampa Sarkar, J.)
