Versus

The State of West Bengal and others Mr. Subhrangsu Panda ... for the petitioner.

Ms. Chaitali Bhattacharya ... for the State.

This is a pension dispute. The petitioner retired from his service as a school teacher on 31st August, 2020. His grievance is that despite submitting all necessary papers for pension, it has not been paid to him till date. Learned advocate for the State appears and submits that there is a dispute as to the higher qualification of the petitioner as he did not have higher qualification in the relevant subject and, therefore, this matter may be sent to the Commissioner of School Education, Government of West Bengal, for giving him a hearing and take a decision.

I think this is a fair proposal on the part of the learned advocate for the State.

Accordingly, I direct the Commissioner/Director of School Education, Government of West Bengal, being respondent no.3 to give an opportunity of hearing to the petitioner and also the District Inspector of Schools, Paschim Medinipur, Secondary Education, being respondent no.5 and the Secretary/Headmaster/

Administrator, Begunia Khetramohan Vidyapity (H.S.), Begunia, Kharagpur, Paschim Medinipur, being respondent no.6 within a period of 60 days from date and to take a decision by three weeks thereafter and to communicate the same by two weeks thereafter to the parties who will be present in the hearing.

With the above direction, the writ application is disposed of.

Urgent certified website copy of this order, if applied for, be made available to the parties upon compliance with the requisite formalities.
