This revisional application seeks expeditious disposal of an application under Section 5 of the Limitation Act, 1963 filed praying for condonation of delay in filing the Misc. Appeal No. 02 of 2025 as well as an application for stay in the said misc. appeal filed before the learned Additional District Judge, Chanchal, Malda.

Learned Advocate appearing for the petitioner submits that the misc. appeal had been filed as far back in February, 2025 but since then the same has been pending. It is submitted that the misc. appeal had been preferred against an order dated February 13, 2024 passed by the learned Civil Judge (Junior Division) in O.C. No. 08 of 2024 whereby the petitioners' prayer for temporary injunction was refused by the learned Trial Court.

It is further submitted that the pendency of the misc. appeal without any justification is prejudicial to the petitioners.

In view of the nature of the order proposed to be passed by this Court, direction for prior service of notice along with a copy of the revisional application on the opposite parties is not being made, however, the petitioners shall remain obliged to serve a copy of the revisional application along with a copy of this order upon the opposite parties within a week from date.

Having heard the learned Advocate appearing for the petitioner and having perused the material-on-record, this revisional application is disposed of by requesting the learned Additional District Judge, Chanchal, Malda to dispose of the application under Section 5 of the Limitation Act, 1963 filed for condonation of delay in filing Misc. Appeal No. 02 of 2025 as expeditiously as possible and preferably within a period of two months from the next date fixed.

With the above observations, C.O. 835 of 2026 stands disposed of. No costs.

7. Urgent photostat certified copy of this order, if applied for, be supplied to the parties subject to compliance with all requisite formalities.
