On the file being sent by the department, this matter was placed in the list. It is running in the list for several weeks and has been called on from time to time.

No one has ever responded when the matter has been called on. The matter, therefor, was placed in the list with the note "First Chance". No one responded even at this stage. Then the matter appeared in the list marked as "Last Chance". Despite being called on several times when the matter appeared in the list marked as "Last Chance", no one appeared.

It appears that the writ petition was filed on behalf of M/s. National Railway Signal Co. (P) Ltd. challenging the certificate proceedings initiated by the Employees Provident Fund Organisation (EPFO) for non-payment of the contribution during the period 09/98 TO 11/03 and 09/91 to 02/03.

On 26th April, 2011 when the matter appeared in the list it was directed to go out of the list with liberty

to mention after eight weeks since the petitioner did not appear when the matter was called on.

It appears that no further steps have been taken in this matter since then.

On a perusal of the application, it appears that with the passage of time the same has become infructuous and as such, the petitioner is no more interested to proceed with the writ petition. The same is accordingly disposed of without any order. Urgent photostat certified copies of this order, if applied for, be supplied to the parties upon compliance of all necessary formalities.
