Learned advocate appearing for the petitioner prays for bail on the ground that petitioner in custody for more than 13 years. Learned advocate for the de-facto complainant draws the attention of the Court to the earlier order passed in CRM (M) 1894 of 2025 wherein there were directions for the In-Charge Court to hear out the arguments.

In this case trial concluded in the year 2024, argument of the prosecution was completed in the year 2024 and the accused commenced their arguments in the year 2024 which continued and stretched till the year 2025. Thereafter, the Presiding Officer was transferred, as such the same could not be completed. There were directions upon the In-Charge Court to conduct the arguments and

deliver the judgment. Subsequent order dated 23.02.2026 of the learned ADJ, FTC-I, Raiganj reflects that one of the accused was absent for which the arguments could not commence. Next date has been fixed on 10th of April, 2026.

In view of the stage of the case, I am not inclined to release the petitioner on bail.

Accordingly, the prayer for bail of the petitioner in CRM (M) 648 of 2026 is dismissed.
