A perusal of the previous order reveals that on number of occasions the matter was listed, but no one appeared for the petitioner.

The record further reflects that this court by order dated 21.02.2013 after taking note of the detailed report submitted by the municipality about the utilisation of fund had dismissed the petition in default as no one had appeared on that date also and thereafter subject to payment of cost, the petition was restored by order dated 18.04.2013.

Subsequent order-sheets reveal repeated default of non-appearance and the petitioner has also not appeared today which shows that petitioner is not interested to prosecute this petition.

The writ petition is, accordingly, dismissed in default.
