From the report it is seen that the appellant no.1 Rahamat Ali Molla @ Rahamat Molla, S/o Late Rabbani Molla of Kastha Kumari, Paschim Chamri, Police Station - Bishnupur, DistrictSouth 24-Parganas had expired on 5th April, 2005 and appellant no.2 Rabial Molla, S/o Late Rabbani Molla, Kastha Kumari, Paschim Chamri, Police Station - Bishnupur, District - South 24-Parganas had expired on 31st May, 2012.

Photocopy of both the death certificates are also annexed by the Chief Judicial Magistrate, South 24-Parganas, Alipore along with the report.

As the appellants have already died, so the instant appeal stands abated against him.

The instant appeal be and the same is dismissed as abated. The appeal being CRA 216 of 1996 stands disposed of. Let a copy of this order along with the Trial Court Records be sent down to the Trial Court at once.
