For the petitioner This application under Article of the Constitution of India has been filed by the petitioner/ plaintiff with a prayer for expeditious disposal of the injunction application under Order XXXIX Rules 1 and 2 of the Code of Civil Procedure filed on 14th August, 2019 which has not yet been disposed of.

Considering the facts and circumstances, I do not find any reason to serve notice upon the opposite party. Thus, service of notice upon the opposite party stands dispensed with.

Accordingly, learned Civil Judge (Senior Division), 2nd Court, Baruipur, South 24-Parganas, is requested to dispose of the injunction application under Order XXXIX Rules 1 and 2 of the Code of Civil Procedure filed on 14th August, 2019 in connection with Title Suit No.344 of 2019, within one month, if possible, from the date of communication of this order.

With the aforesaid observation, the revisional application, being CO 751 of 2023, stands disposed of. Learned advocate appearing on behalf of the petitioner is at liberty to bring this order to the notice of the learned Civil Judge (Senior Division), 2nd Court, Baruipur, South 24-Parganas, forthwith.

Urgent photostat certified copy of this order, if applied for, be given to the parties, upon compliance of necessary formalities.
