Affidavit-of-service filed in Court today by the Counsel for the petitioner be taken on record. The petitioner was the highest paid employee of Bidurpur Samabai Krishi Unnayan Samity Limited. He was the custodian of the Society's vault and other documents for a substantial period of time of about five years.

Pursuant to the orders of this Court passed in W.P.C.R.C. No. 3 of 2021 and W.P.C.R.C. No. 4 of 2021, the petitioner was directed to hand over the keys, day book and other documents of the Society in his custody.

The petitioner claims to have handed over the same on 8th January, 2021.

By three several communications dated 11th January, 2021, 2nd February, 2021 and 2nd March, 2021, the petitioner has been asked to remain present at the time of opening of the vault. The petitioner is aggrieved by the same.

This Court sees absolutely no reason for the petitioner to be aggrieved if he is being called to be present at the time when the vault of the Society is opened.

The petitioner admittedly was the custodian for the said vault and other documents for a period of five years. His presence is absolutely necessary. The petitioner, therefore, be personally present on the next date when the Secretary of the Society shall propose to open the vault.

The other office bearers of the Society and the ARCS and the local police personnel shall also be present at such time. In the event, the petitioner does not co-operate or be present, the Officer-in-charge, Egra Police Station shall ensure the presence of the petitioner at the said Society.

With the aforesaid directions, the instant writ petition shall stand disposed of.

There will be no order as to costs.

Urgent photostat certified copy of this order, if applied for, be given to the parties upon compliance of all formalities.
