Learned Advocate for the State submits that a compliance report dated 28th January, 2025 from which it appears that complainant Anil Kumar Saha has expired on 18th May, 2024 as it appears from death certificate issued by the Gram Panchayat, Radharghat-I on 31st May, 2024. He also submits that cremation certificate of sole accused Suhrit Krishna Ghosh issued by Calcutta Municipal Corporation, Health Department on 17th January, 2025 to show his death. Let the report be taken on record.

Learned Advocate for the petitioner submits that after death of complainant and petitioner/sole accused, now this application becomes infructuous.

Accordingly, this matter has become infructuous and liable to be dismissed.

Learned Advocate for the State also submits the same.

Considering the change in circumstances resulting after the death of petitioner, accused and opposite party no.2/complainant related to this matter be disposed of as infructuous.

There shall be no order as to costs.

Interim order, if any, stands vacated.

Urgent photostat certified copy of this order, if applied for, be supplied to the parties subject to compliance with all requisite formalities.
