The petitioners' grievance in this application is directed against the alleged inaction on the part of the State respondents to issue the environmental clearance based on which they can carry on mining operations in the district of Purulia.
The writ petition was filed alleging that since the concerned respondent is not issuing the environmental clearance, the petitioners have been unable to carry on any mining operations in the district of Purulia. It is, however, submitted by the learned advocate appearing for the petitioners that during the pendency of the writ petition, the concerned State respondents have started the process to consider their prayer for issuance of the environmental clearance.
In view of the above submission made by the petitioners, I do not find any reason to keep the present writ petition pending. Accordingly, W.P.A. 4488 of 2020 stands dismissed.
It is, however, made clear that if the environmental clearance is refused to the petitioners, they shall have a fresh cause of action to approach this Court claiming appropriate relief.
