-Vs.- Smt. Madhumita Rana @ Hela (Jamadar) Mr. Panchanan Hazra .....For the Petitioners A direction to secure expeditious disposal of Act 39 Misc. Case No.22 of 2010, now pending before the Learned Court of District Delegate, Hooghly being, Learned Civil Judge (Senior Division) Arambagh, Hooghly is the ultimate relief sought for in this case. The only contention expressed by the learned advocate for the petitioners is that due to the pendency of this succession case, the petitioner no.1 has been deprived of getting her family pension from the appropriate authority concerned. In view of the nature of the order proposed to be made in this case, no prior notice upon the opposite parties is considered to be necessary. Service upon the opposite parties is, thus, dispensed with.

Accordingly, Learned Civil Judge (Senior Division) Arambagh, Hooghly being, District Delegate in Act 39 Misc. Case No.22 of 2010, is requested to ensure expeditious disposal of pending succession case, after causing disposal of

interlocutory application, if there be any pending, providing sufficient opportunity of hearing to either of the parties to this case, but without any unnecessary adjournment, unless it extremely unavoidable.

While endeavouring such exercise, the Learned Court below may proceed with the disposal of pending succession case in the manner, as situation of the case would demand, so as to dispense with the justice in a best possible manner. Petitioners are directed to make communication of this order to the learned court below as well as the learned advocate appearing in the court below for the opposite parties. With this direction and observation the revisional application stands disposed of.

Urgent certified photostat copy of this order, if applied for, be given to the parties as expeditiously as possible on compliance of all necessary formalities.
